ROADS (SCOTLAND) ACT 1984 AND THE ACQUISITION OF LAND (AUTHORISATION PROCEDURE) (SCOTLAND) ACT 1947

THE M9 BURGHMUIR DEPOT ACCESS ROAD COMPULSORY PURCHASE ORDER 201[ ]

Notice is hereby given that the Scottish Ministers, in exercise of the powers conferred by the above mentioned Acts, on the 27th day of January 2012 prepared a Compulsory Purchase Order entitled “The M9 Burghmuir Depot Access Road Compulsory Purchase Order 201[ ]”, which affects the land described in the Schedule hereto for the purpose of obtaining continued access to the existing Burghmuir maintenance depot.

The Order is about to be made and comes into operation only if made. If the Order is made, a conveyance registered in implement of the Order may vary or extinguish rights to enforce real burdens and servitudes affecting the land.

Copies of the draft Order and of the map referred to therein have been deposited at:

The offices of Transport Scotland, Buchanan House, 58 Port Dundas Road, Glasgow G4 0HF and may be seen there free of charge between 8:30am – 5:00pm (Mon – Thurs), 8:30am – 4:30pm (Fri); the offices of West Lothian Council, County Buildings, High Street, Linlithgow EH49 7EZ and may be seen there free of charge between 8:30am – 5:00pm (Mon, Tue, Thurs), 10:30am – 5:00pm (Wed), 8:30am – 4:00pm (Fri); Linlithgow Library, 7 The Vennel, Linlithgow EH49 7EX and may be seen there free of charge between 9:30am – 5:30pm (Mon and Fri), 9:30am – 8:00pm (Tue and Thurs), 10:00am – 5:30pm (Wed), 9:30am – 1:00pm (Sat); Boness Library, Scotlands Close, Boness EH51 OAH, and may be seen there free of charge between 9:30am – 8:00pm (Mon, Tue and Thurs), 9:30am – 5:00pm (Wed, Fri and Sat).

Any objection to the Order must be made in writing stating the title of the Order and the grounds of objection and addressed to the Director, Trunk Road and Bus Operations, Transport Scotland, Buchanan House, 58 Port Dundas Road, Glasgow G4 0HF quoting reference JMC/NSE/M9 Any objections must be received on or before 24th February 2012.

In this Schedule the plot references and areas referred to below correspond to those given in the Schedule and the map annexed to the draft M9 Burghmuir Depot Access Road Compulsory Purchase Order 201[ ]

2,673 square metres or thereby of the solum of Green Loan, being that part of unclassified road between the C16 road and the Burghmuir Depot, lying to the north of Kingsfield and to the east of Burghmuir Depot.
