NOTIFICATION OF ORDER UNDER SECTION 426 OF THE INSOLVENCY ACT 1986

Notice is hereby given that on 26 August 2010, following submission of a Letter of Request by the High Court of Ireland (“the Irish Court”), a Petition for an order under section 426 of the Insolvency Act 1986 was presented to the Court of Session (“the Court”) by Comhfhorbairt (Gaillimh), a company incorporated in the Republic of Ireland with its registered office at 1 Northwood Avenue, Santry, Dublin, Ireland (“the Company”). In that Petition, the Court made an interim order dated 26th August 2010 that (a) The appointment of the Michael McAteer, Chartered Accountant, Grant Thornton, 24-26 City Quay, Dublin, Ireland as Examiner of the Company and the Order as to the examinership of the Company be recognised in Scotland; (b) The Examiner has such powers as would be available to them under the Company (Amendment) Act 1990 (Republic of Ireland); (c) For so long as examinership of the Company continues save with the leave of the Court or the Irish Court or the consent of the Company that (1) no proceedings may be commenced within the jurisdiction of the Court for the winding up of the Company; (2) no receiver or administrator of any part of the property or undertaking of the Company within this jurisdiction shall be appointed; (3) no diligence shall be instituted or continued against the property of the Company within Scotland; (4) where any claim against the Company is secured by a charge on the whole or any part of the property, of the Company within Scotland, no action may be taken to realise the whole or any part of such security; (5) no steps may be taken to repossess goods within Scotland in the Company’s possession under any hire purchase or leasing agreement; and, (6) no proceedings within Scotland may be commenced or continued in relation to the Company. The Court also allowed any party claiming an interest to lodge Answers within 21 days after advertisement and service of the petition in the Edinburgh Gazette and The Herald newspaper.
